Terms of Service

These Terms of Service ("Terms") govern your use of the Bamaja mobile application and the AI services accessed through it ("Bamaja", "the App", "the Service"). The Service is operated by Bamaja Integrated Online Services Limited, a company registered in Nigeria with its principal office in Lagos ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Bamaja Provides

Bamaja is an AI-powered mobile application that gives Nigerian users access to multiple AI assistants ("Bots") through a single account and shared credits wallet. The Bots include:

NaijaBot — AI assistant for news, market prices, exchange rates, jobs, traffic, sports, entertainment and other Nigeria-relevant questions.
PixBot — AI photo studio that generates stylised portraits from your selfies.
HustleBot — AI money-plan assistant that helps you turn skills into income.
LearnBot — AI tutor that builds learning roadmaps and lessons.
GistBot — Free Nigerian news and gist feed.
BirthdayBot — AI-generated birthday reading (entertainment).
ChopWise — AI food calorie and macro scanner.

We may add, remove, or change Bots at any time without prior notice.

2. Eligibility and Accounts

You must be at least 13 years old to use Bamaja.
If you are under 18, you must have your parent or legal guardian's permission.
You agree to provide accurate information when creating your account (real phone number or email).
You are responsible for keeping your login credentials secure. We are not liable for unauthorised use of your account caused by your failure to protect your credentials.
One person per account. Sharing accounts is not permitted.

3. Credits, Payments, and Refunds

Some Bots require credits to use. Credits are sold through Google Play Billing as in-app purchases.

Two wallets: Bamaja Credits (used across NaijaBot, HustleBot, LearnBot, BirthdayBot) and PixBot Credits (used only for PixBot image generation). They are not interchangeable.
Free credits may be granted to new users for trial purposes. They expire after a set period and have no cash value.
Pricing is displayed in the App at the time of purchase. We may change pricing for future purchases without prior notice.
Refunds for in-app purchases are handled exclusively by Google Play. We do not process refunds directly. Refund eligibility is determined by Google Play's policies.
No cash value: Credits are a service entitlement, not currency. They cannot be exchanged for cash, transferred between accounts, or withdrawn.
Account termination: If your account is terminated for violation of these Terms, any remaining credits are forfeited.

4. AI-Generated Content — Important Disclaimer

The content produced by Bamaja's AI Bots is generated by machine learning models and may contain errors, inaccuracies, or biases.

You must not rely on AI-generated content as a substitute for:

Professional medical, health, or nutrition advice (consult a doctor or dietitian)
Legal advice (consult a lawyer)
Financial or investment advice (consult a licensed financial adviser)
Educational accreditation (LearnBot is for self-learning, not certification)
Verified news (always cross-check important information with reputable sources)

We do not warrant the accuracy, completeness, or fitness for any particular purpose of any AI-generated content.

5. Acceptable Use

You agree NOT to use Bamaja to:

Generate, share, or store content that is illegal under Nigerian law
Generate sexual content, hate speech, harassment, or content that promotes violence
Generate content depicting real people without their consent, or that could deceive others into believing it is real (deepfakes for malicious purposes)
Generate content that infringes intellectual property rights (e.g. recreating copyrighted characters, branded designs)
Spam, scrape, scan, or attempt to extract our data or models in bulk
Reverse-engineer, decompile, or circumvent any technical protection
Use the Service to compete with us by training competing AI systems on our outputs
Misrepresent yourself or impersonate another person
Use multiple accounts to bypass credit limits or other restrictions

We may suspend or terminate accounts that violate these rules without prior notice.

6. Your Content and Photos

You retain ownership of any photos, text, or other content you upload to Bamaja ("Your Content").

By uploading, you grant us a limited, non-exclusive licence to process Your Content for the sole purpose of providing the Service to you (for example, generating PixBot images from your selfies, identifying food in ChopWise).

We do not use Your Content to train our AI models without your explicit consent.

7. AI Content Reporting

If you encounter AI-generated content from Bamaja that you believe is harmful, inaccurate, offensive, or violates these Terms, please report it to support@nigeriafaces.com. We review all reports and may remove content or suspend accounts based on findings.

8. Intellectual Property

The Bamaja App, brand name, logos, design, code, and AI prompts are owned by Bamaja Integrated Online Services Limited and protected by copyright and trademark law.

You may not copy, modify, or redistribute any part of the Service without our written permission.

Outputs generated by AI Bots are provided to you for your personal and commercial use, subject to the acceptable use rules in Section 5.

9. Termination

You may delete your account at any time via the in-app account deletion option or by visiting bamaja.online/delete-account.

We may suspend or terminate your access immediately, without notice or liability, if you violate these Terms, if required by law, or if continued provision becomes commercially impractical.

Upon termination, your right to use the Service ceases. Credits, history, and uploaded content are deleted in accordance with our Privacy Policy.

10. Service Availability and Changes

We aim to keep the Service available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any feature, Bot, or the entire Service at any time.

We will give reasonable notice of material changes that affect paying users where practical.

11. Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that the Service will be error-free, uninterrupted, secure, or that AI outputs will be accurate.

To the maximum extent permitted by Nigerian law, our total liability to you for any claim arising from your use of the Service is limited to the amount you have paid us for credits in the 12 months preceding the claim, or NGN 5,000, whichever is greater.

We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost data, or business interruption.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top and may notify you in the App. Your continued use of the Service after changes means you accept the updated Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria.

Before starting any formal legal action, you agree to first contact us at support@nigeriafaces.com and give us a reasonable opportunity to resolve the dispute informally.

14. Third-Party Services

Bamaja uses third-party services to provide AI features. These include:

Google (Gemini API) — for AI image analysis and food identification
OpenAI — for AI text and image generation
Google Play Billing — for processing in-app purchases
Paystack — for processing payments on the website version

Your use of those services is also subject to their own terms.
